1. Introduction and Platform Role

This Content & Moderation Policy (“Policy”) describes the content standards, moderation practices, and enforcement procedures that govern all content displayed on the RaffleTracker™ mobile application, website (raffletracker.app), and all associated services (collectively, the “Platform”). This Policy applies to all Partners, users, and visitors of the Platform.

RaffleTracker operates solely as a discovery and promotional listing platform that provides users with information about giveaways conducted by independent third-party Partners. RaffleTracker does not sponsor, administer, operate, manage, conduct, or control any sweepstakes, raffles, contests, lotteries, or promotional drawings listed on the Platform. All promotions listed on the Platform are conducted exclusively by the respective Partners, and all entry submissions, eligibility determinations, winner selection, prize fulfillment, and compliance with applicable laws are the sole responsibility of the Partner conducting the promotion. Participation in any Giveaway occurs exclusively on the Partner’s website. RaffleTracker does not accept entry submissions, process payments for promotion entries, determine winners, distribute prizes, or otherwise participate in the operation of any promotion. The Platform merely provides a directory of promotional opportunities and does not constitute a gambling service, lottery operator, raffle administrator, or promotion sponsor.

RaffleTracker does not independently verify, review, certify, or approve the legality, regulatory compliance, or lawfulness of any Giveaway Listing or the underlying promotion. RaffleTracker’s review of Giveaway Listings prior to publication is limited to the content standards described in this Policy. The fact that a Giveaway Listing has been published on the Platform does not create any presumption or representation of legality or regulatory compliance.

This Policy supplements and is incorporated into the RaffleTracker Partner Terms of Service, Content License Agreement, Giveaway Compliance Acknowledgment, User Terms of Service, and Privacy Policy. In the event of a conflict between this Policy and any of those agreements, the more restrictive provision shall control.

2. Giveaway Listing Content Standards

All Giveaway Listings submitted by Partners for display on the Platform must comply with the following content standards. RaffleTracker reviews listings against these standards prior to publication and on an ongoing basis.

2.4 Regulated Product Giveaways

RaffleTracker does not endorse or promote giveaways involving regulated products. Partners offering Giveaways involving regulated items such as firearms, ammunition, alcohol, tobacco, cannabis, or pharmaceutical products are solely and exclusively responsible for compliance with all applicable federal, state, and local laws governing the promotion, advertising, transfer, and distribution of such items. RaffleTracker may impose additional review requirements, content restrictions, or labeling on regulated product listings at its sole discretion.

2.5 Age-Appropriate Content and Minimum Age

The Platform is intended for users aged eighteen (18) and older. Individuals under the age of eighteen (18) are not permitted to use, access, or register for an account on the Platform. The eighteen (18) year age requirement is in place because the Platform may display promotions involving regulated products such as firearms, ammunition, alcohol, tobacco, and other age-restricted items. All Giveaway Listings and Partner Content must comply with the following age-related content standards:

Partners are solely responsible for implementing age verification or eligibility gating on their own entry pages where required by law. RaffleTracker does not independently verify the age of users or entrants for any Partner promotion.

3. Promoted and Sponsored Content

The Platform may display certain Giveaway Listings as paid placements by Partners. These listings are subject to the same content standards as all other listings on the Platform, plus the following additional requirements:

3.1 Labeling and Disclosure

Paid promotional placements will be clearly labeled with designations such as “Sponsored,” “Promoted,” “Featured,” or similar disclosures. These labels are applied by RaffleTracker in compliance with Federal Trade Commission (FTC) endorsement and advertising guidelines and applicable advertising law. Partners may not request, require, or attempt to cause RaffleTracker to conceal, obscure, or omit the paid or sponsored nature of any promotional placement.

3.2 No Endorsement

Promotional placement reflects paid visibility or editorial placement and does not constitute endorsement, verification, approval, or recommendation by RaffleTracker of the Partner, the Giveaway, the prize, or any claims made in connection with the promotion. The presence of a “Promoted” or “Sponsored” label indicates that the Partner has paid for enhanced visibility — it does not mean RaffleTracker has verified the legality, legitimacy, or quality of the Giveaway.

3.3 Promoted Content Review

Promoted listings undergo the same content review as non-promoted listings. Paying for promoted placement does not exempt a listing from compliance with this Policy. RaffleTracker reserves the right to reject, suspend, or remove any promoted listing that violates Platform content standards, regardless of payment status. Refunds for removed promoted listings are governed by the Partner Terms of Service.

4. User Conduct Standards

All users of the Platform are expected to use the Platform responsibly and in compliance with the following standards:

RaffleTracker moderates content on the Platform through a combination of pre-publication review, ongoing monitoring, user reporting, and automated systems.

5.1 Pre-Publication Review

All Giveaway Listings submitted through the Partner Portal are reviewed by RaffleTracker before publication. Pre-publication review evaluates listings against the content standards described in Section 2 of this Policy and may include review of the listing text, images, Entry URL, prize description, and sponsor information. Pre-publication review is a content-standards check only — it does not constitute a legal review, legal approval, or verification of the Giveaway’s compliance with applicable law.

RaffleTracker has no obligation to publish, display, or continue displaying any Giveaway Listing or Partner Content. Submission of a listing does not guarantee publication, and RaffleTracker may decline to publish any listing for any reason at its sole discretion, including for reasons not specified in this Policy.

5.2 Ongoing Monitoring

RaffleTracker may monitor published listings on an ongoing basis for compliance with this Policy. Ongoing monitoring may include periodic review of active listings, automated detection of expired or modified Entry URLs, review of user reports and complaints, and analysis of engagement patterns that may indicate fraudulent or bot-driven activity.

5.3 User Reporting

Users may report any Giveaway Listing, Partner, or user conduct that they believe violates this Policy through the following channels:

RaffleTracker will review all reports in good faith and take appropriate action. RaffleTracker will not retaliate against users who submit good-faith reports, and Partners may not retaliate against users who file complaints. RaffleTracker may follow up with the reporting user if additional information is needed but is not obligated to disclose the specific enforcement action taken.

5.4 Partner Reporting

Partners may report intellectual property infringement, unauthorized use of their Brand Assets, or other violations by contacting RaffleTracker at legal@raffletracker.app. For copyright infringement, Partners and other rights holders should follow the DMCA notice procedures described in Section 8 of this Policy.

5.5 Automated Moderation

RaffleTracker may use automated tools, algorithms, or systems to assist with content moderation, including but not limited to detection of expired links, identification of duplicate or spam listings, flagging of content that may violate Platform standards, and monitoring of engagement patterns for anomalies. Automated moderation systems supplement but do not replace human review for enforcement decisions.

6. Enforcement and Consequences

RaffleTracker enforces this Policy through a tiered system of consequences. The specific enforcement action taken depends on the severity of the violation, whether the violation is a first or repeat offense, the potential harm to users, and other relevant circumstances. RaffleTracker reserves the right to take any of the following actions at its sole discretion, with or without prior notice:

RaffleTracker may take immediate enforcement action without prior notice in the following circumstances:

6.3 Repeat Violations and Repeat Offenders

RaffleTracker maintains a record of all enforcement actions taken against Partners and users. A pattern of violations — including but not limited to multiple content removals, user complaints, DMCA takedowns, regulatory inquiries, fraud reports, or failure to provide requested compliance documentation — will result in escalated enforcement. The escalation path is:

RaffleTracker reserves the right to skip escalation tiers and proceed directly to suspension, termination, or permanent ban where the severity of the violation warrants immediate action (as described in Section 6.2). The escalation path above is a guideline, not a binding commitment, and RaffleTracker retains sole discretion over all enforcement decisions.

6.4 Platform Safety and Reputation Protection

RaffleTracker may suspend, remove, decline to publish, or restrict the visibility of any Giveaway Listing, Partner Content, or user account that, in its reasonable judgment, may harm the safety, integrity, trustworthiness, or public reputation of the Platform or its users. This authority exists independently of any specific Policy violation and may be exercised in response to: user safety concerns, including reports of harm, harassment, or threats; negative media coverage or public complaints related to a Partner or Giveaway; regulatory inquiries, investigations, or enforcement actions involving a Partner; concerns about prize legitimacy; or any other circumstance that RaffleTracker determines, in good faith, may adversely affect user trust in the Platform.

Actions taken under this Section are not punitive and do not require a finding of Policy violation. RaffleTracker will make reasonable efforts to notify the affected Partner when action is taken under this Section, but may act without prior notice where user safety or Platform integrity requires immediate action.

6.5 Notification of Enforcement Actions

When RaffleTracker takes an enforcement action against a Partner or user, RaffleTracker will generally provide notice of the action, including the specific content or conduct that triggered the action, the applicable Policy provision(s), the enforcement action taken, and information about the appeals process described in Section 7. Notice will be provided via the email address associated with the Partner or user account. RaffleTracker may withhold specific details where disclosure could compromise an ongoing investigation, jeopardize user safety, or interfere with a regulatory or legal proceeding. In cases of immediate action under Section 6.2, notice may be provided after the action is taken.

7. Appeals

Partners and users who believe an enforcement action was taken in error may submit an appeal to legal@raffletracker.app within thirty (30) days of the enforcement action. Appeals must include:

RaffleTracker will review appeals in good faith and respond within fourteen (14) business days. Appeal decisions are made by RaffleTracker in its sole discretion and are final. Submitting an appeal does not suspend the enforcement action during the review period. RaffleTracker is not obligated to provide detailed reasons for its moderation decisions beyond confirming the policy basis for the action.

8. Intellectual Property and DMCA Complaints

RaffleTracker respects intellectual property rights and responds to valid notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA) (17 U.S.C. §512).

8.1 Filing a DMCA Takedown Notice

If you believe that content on the Platform infringes your copyright, you may submit a DMCA takedown notice to RaffleTracker’s designated DMCA agent at legal@raffletracker.app. Your notice must include:

8.2 DMCA Counter-Notification

If your content was removed in response to a DMCA takedown notice and you believe the removal was in error, you may submit a counter-notification to legal@raffletracker.app containing the information required under 17 U.S.C. §512(g). RaffleTracker will forward the counter-notification to the original complainant. If the complainant does not file a court action within the statutory period, RaffleTracker will restore the content.

8.3 DMCA Agent Designation

RaffleTracker has designated a DMCA agent with the United States Copyright Office in accordance with 17 U.S.C. §512(c)(2). Registration No. DMCA-1071152. All intellectual property complaints should be directed to legal@raffletracker.app.

8.4 Repeat Infringers

In accordance with the DMCA, RaffleTracker maintains a policy of terminating, in appropriate circumstances, the accounts of Partners and users who are repeat infringers of copyright.

9. Partner Compliance and Documentation

RaffleTracker reserves the right to request documentation from Partners verifying the legality and compliance of their Giveaway Listings at any time. Requested documentation may include:

Partners must provide requested documentation within fourteen (14) days. Failure to provide documentation within the specified timeframe may result in listing removal and account suspension. Provision of materially incomplete, inaccurate, or falsified documentation may result in immediate account termination.

10. Platform Integrity and Abuse Prevention
10.1 Bot and Automated Abuse Prevention

The use of automated systems, bots, scripts, scrapers, or artificial traffic generation methods to interact with the Platform is prohibited. This includes but is not limited to manipulating engagement metrics (such as watcher counts or favorites), inflating referral attribution data, scraping Giveaway Listing data or partner information, circumventing or disabling Platform attribution mechanisms, and automated creation of user accounts. Violation may result in immediate suspension or permanent ban without prior notice.

10.2 Engagement Metric Integrity

RaffleTracker does not guarantee the accuracy of engagement metrics displayed on the Platform (such as watcher counts, popularity indicators, or interaction data). Partners may not rely on Platform-displayed metrics for regulatory disclosures, legal representations, odds calculations, or any official reporting purposes. Manipulation of engagement metrics is a serious violation of this Policy.

10.3 Non-Circumvention

Partners shall not intentionally solicit, contact, or redirect RaffleTracker users for off-platform promotional participation in a manner designed to circumvent the Platform’s tracking, attribution, discovery, or partnership structure. Partners shall not embed hidden redirects, tracking pixels, or data collection mechanisms in Giveaway Listings designed to capture RaffleTracker user data for off-platform solicitation. This restriction does not prevent Partners from promoting their Giveaways through their own independent marketing channels to audiences they acquired independently of the Platform.

10.4 Platform Data Protection

Partners shall not use non-public Platform information, including Restricted Platform Information as defined in the Partner Terms of Service, to develop, operate, assist, or invest in any service that competes with the Platform. Partners shall not reverse engineer, decompile, or systematically analyze the Platform for the purpose of replicating its features, workflows, or user experience. Violation of Platform data use restrictions is governed by Section 9 of the Partner Terms of Service.

11. Content Modifications by RaffleTracker

RaffleTracker may make the following modifications to Partner Content in connection with Platform display and operation:

RaffleTracker shall not materially alter prize descriptions, prize values, eligibility requirements, entry methods, or official rules without the Partner’s prior approval. Material changes to other aspects of listing content substance will be communicated to the Partner when practicable.

12. Data and Privacy in Moderation

In the course of moderation activities, RaffleTracker may collect and process the following information:

Information collected in connection with moderation activities is used solely for the purposes of enforcing this Policy and maintaining Platform integrity. Such information is handled in accordance with the RaffleTracker Privacy Policy and applicable law.

12.1 Moderation Data Retention

Moderation records are retained according to the following schedule, consistent with the retention periods described in the RaffleTracker Privacy Policy:

Retention of moderation data in backup and archival systems does not constitute continued active use of the data. RaffleTracker may retain moderation data beyond the periods described above where required by law, regulation, or pending legal proceeding.

13. Changes to This Policy

RaffleTracker may update this Content & Moderation Policy from time to time to reflect changes in our practices, technology, legal requirements, or Platform features. We will notify Partners and users of material changes by posting the updated Policy on the Platform with a revised effective date. Continued use of the Platform after changes are posted constitutes acceptance of the revised Policy.

Partners are encouraged to review this Policy periodically. Significant changes to content standards or enforcement procedures will be communicated to active Partners via email at least fourteen (14) days before taking effect, except where immediate changes are required for legal compliance, user safety, or fraud prevention.
